"the factor" begins right now. hi, i'm bill o'reilly. happy new year. thanks for watching us tonight. the straight story about the murders in benghazi, that is the subject of this evening's talking points memo. over the christmas break, "the new york times" ran an investigative report about how atmosphere christopher stevens and three other americans were murdered in libya in september

11, 2012. the story has been a sharp thorn for the obama administration and for former secretary of state hillary clinton, because there were security concerns in benghazi not addressed by the state department, also because the administration's version about what happened was murky and allegedly misleading. "the times" concluded that there is no evidence, no evidence, that al qaeda was involved in the murders and an antimuslim video promoted by a florida preacher did ignite the fuse of violence as the obama administration initially stated. but a factor analysis of "the times" article casts grave doubt on both of those conclusions. let's look at the facts. "the new york times" rightly claims that an anti-american group was behind the attack, but "the times" says the group is not afill yalted with al qaeda. the evidence says otherwise. in august 2012, a few weeks before the attack, the pentagon, the pentagon, issued a report

that said, "ann swar al sharia has increasingly embodied al qaeda's presence in libya." but "the times" does not mention, does not mention, the pentagon's assessment in its article. an amazing lapse, and a huge mistake. if the paper wants its readers to believe it is covering hard news in a fair way. simply no excuse for not including the pentagon's point of view. "the times" also says, "the attack seems to not be meticulously plans." nonsense. for hours thugs used grenades and automatic weapons to assault the u.s. missions compound in benghazi. militants were seen on video cameras chasing the mission before the attack and they hid

themselves until opening fire. they also attacked a cia compound a half mile away using mortars, and "the new york times" says the attack was not planned. are you kidding me? i guess the word "meticulously" is the paper's fallback, but it is pure bull. and the coordinated violence eliminates the videotape as a spontaneous driver of the murders, eliminates that. it's true, the militants knew about the tape from egyptian tv, but this ann sar group used violence before. they didn't need a tape to commit murder. so talking points believes "the times" story is deeply flawed and the editors should have known it. now, over the years, the paper has become deeply invested in changing america into a secular progressive country, and while it does do some noble reporting,

a primary goal of "the times" is to help progressive groups and politicians. you may remember "the times" implied that john mccain had an extramarital affair during his presidential campaign against barack obama. "the times" could produce no evidence, none, to justify that story, and to this day, senator mccain is bitter about it. now we have the lingering benghazi situation that may hurt hillary clinton in her presidential run. talking points believes that was the motivation for the way this investigation was framed by "the new york times." i could be wrong, but i'm not wrong about the reporting. it is seriously flawed. and that's the memo. for top story tonight, joining us from washington howard kurtz and bob goldburg, both are fox news analysts. am i making mistakes here? >> on the factual matter, i completely agree with you. on your theory that if the "new

york times" consciously had a pro hillary agenda, i don't know. could be. as you know, bill, there is never a smoking gun memo that says let's hurt the liberals and help the conservatives, but i think the reason so many people think the way you do about this, two reasons, two main reasons anyway. the first reason, on the main conclusion in the 7,000-word "new york times" piece that al qaeda wasn't involved, you're right. there are many responsible people in responsible positions who don't agree with that, one of those responsible people is a liberal democrat on the house who says al qaeda wasn't involved. >> who's that? >> that was adam ship in california. the second reason is, that "the new york times" has a, let's call it a credibility problem, mainly with conservatives.

the paper went easy on barack obama when he ran for president. there's a strong suspicion they are going to go easy on hillary when she runs, and not just on the editorial page, and because of that, and because of the mccain example that you correctly gave, a page one story with no proof implying that he had this affair, "the new york times" over the years has squandered a lot of its credibility, and i think that's why you and others, whether there's an agenda or not -- i know, but i'm saying, let's just say others. >> okay. >> whether there's an agenda or not, believe there is. >> okay, let's get to kurtz who worked for "the washington post," who knows about the bureaucracy of these newspapers. there are ten, ten, managing or associate editors on the masthead of "the new york times." ten. the overall editor, jill abe programson, an avowed liberal woman, way to the left, all right, okay, you're telling me,

kurtz, that ten editors who read this article in advance, none of them would say, you know what, the pentagon contradicts this. none of them do that? that's impossible! >> some of the reporting here may be flawed, you pointed to a serious omission, bill, but this was a serious attempt at journalism done over many months with many on the record interviews, including the prime suspect in the case, and you're sophisticated to know that you don't have your cairo bureau chief spend months on a story, which didn't mention hillary clinton at all, in order to help a likely presidential candidate two years from now, that's not how news works. >> you're kidding me. you're kidding me. you actually believe this story is a serious piece of journalism when you leave out the central tenant of what you're trying to say, no al qaeda involvement, you leave out the assessment of the pentagon and you're telling me that's serious?

>> i said it was a serious omission, but even if you accept -- i know you don't -- even if you accept every sentence as true, it paints a portrait of a compound in libya left undefended. >> what it does make the administration look credible, because it goes back to the videotape, which is what susan rice came out with and why republicans and some conservatives went wild and says, yeah, the videotape was the reason. the two main things, kurtz, the two main things, al qaeda and the tape, are wrong. wrong. all right? according to almost every intelligence expert in the world, this ann sar al sharia group has ties with al qaeda, and they don't even mention it. >> whether or not this group has ties to al qaeda or not, they were local extremists out to kill americans. >> doesn't matter. you have to mention the other side, and they did not.

all right. god help me, i'm giving goldberg the last word on this. goldberg, you've got it. >> well, if you conclude that al qaeda was not involved, by the way, president obama was running for re-election in part saying al qaeda was on the run. if you conclude al qaeda was not involved, you leave out a credible evidence to the contrary, it makes you wonder. that's all i'm saying. it makes you wonder about whether they had motives or not. now, i happen to agree with howard that two years out, they are not sitting there and having a secret meeting where they pull down the shades and give the secret salute and say let's do something to help hillary. >> they don't do that. they don't do that. >> they never do that. >> they want an article with a certain flavor. that's what they want. >> but my point is, bill, that when you leave out important things and you're already under suspicion, again, mainly by the right, they are not going to give you the benefit of the doubt. >> well, i think i shredded that

our lead story, "the new york times" coverage of the benghazi controversy. joining us, james carville. i think i laid out a lucid case, that this article, investigative article, page one, was flawed. would you disagree with just that, the article is flawed? >> what i think we should do is,

another controversy that nbc news and its parent company comcast have to deal with. on december 29th, msnbc commentator melissa harris-perry talked about the romney family adopting an african-american child. >> this is the romney family, and, of course, there on governor romney's knee is his adopted grandson, who is an african-american, adopted african-american child, any captions for this one? >> one of these things -- >> my goal is that in 2040, the

biggest thing of the year will be the wedding between keerin romney and north west. can you imagine romney and kanye west as in-laws? >> harris-perry has apologized to the romney family, but this seems to be a never ending saga at msnbc. i don't think ms. harris-perry meant to be malicious here, unlike martin bashir and ed schultz and his comments directed to you, but she and her guests were clearly mocking the romney family, who did a good thing. >> why mention the race of the child at all? i thought we were supposed to be beyond race, yet every chance they get, the left has to say, okay, ha, ha, ha, caption here, please. i mean, imagine, bill, if you did that or i did that on the radio, you did that on television in a similar setting. sandra bullock's child, look, i have a daughter who's from latin

america. she's pretty brown skinned, you know, you just don't do that, right? i don't want to make a bigger deal of it than it is, because i think a lot of other things that happened at msnbc have been much more egregious, but again, the type of thing that the left tends to get away with, especially involving whites and -- versus blacks. they seem to get away with this kind of stuff time and again, and we've become kind of numb to it, but it certainly isn't helping the cause of liberalism, which i think msnbc strives to assist at all terms. >> the picture they were referring to with the black child was a christmas card that the romneys sent out. and they wanted to demean mitt romney and his family, that was the tone of the three of them. now you worked at msnbc, see, i problem over there, that there is a culture that either promotes or encourages in some

way these personal attacks, because they've trafficked in them for years. now it's reached critical mass on a lot of different fronts. am i wrong? >> look, leadership comes from the top down, and most news organizations, roger ailes sets the tone for fox, and i think we all try to live up to that, and i think at msnbc, you have phil griffin. i worked with phil at msnbc, he's always nice to me. i think it was in the early days from '96 to 2000 when i was there, and it was a different sensibility. it was kind of more edgy than lefty, right? you had a lot of conservative voices at msnbc at the time and it was a little bit more interesting back then, and now it seems as they've become more desperate, bill, in the quest to make some dent in these ratings, it's almost like people have to almost one-up each other. either that or they are just incredibly stupid, which could be a possibility. >> they are not incredibly stupid, i mean, they are not doing well.

if cnn is -- cnn, by the way, doesn't do this stuff very much. >> no. >> but they are in big trouble ratingswise and msnbc beats them by a little, and i guess they feel that this far left approach they take is the reason why, but i couldn't to be amazed by comcast, the parent company of nbc, owns it, took it over from general electric, because i've dealt with comcast in the past, and it's a good company, in my opinion. they know what's going on. they are a liberal crew to some extent, but not irresponsible. and they are allowing this to happen. this is just embarrassing, is it not? >> yeah, brian roberts, the ceo of comcast, is a pretty big democrat donor, couple hundred thousand to democrats, i believe, and $27,000, might be getting the numbers off a little bit, for republicans. there's quite a differential between his democratic donations and republican donations. i think their affinity is to the

left, but i'll ask this question of mr. roberts, how is this helping liberalism? if you're a liberal, you want an effective liberal. someone like rachel maddow -- >> she is responsible, she makes her point, she believes what she says, she's not malicious. >> no, i don't think so. >> why can't you hire a few more of those kind of people? now make a prediction. make a prediction, is comcast going to step in and do anything about this network? >> well, i would like to think they would. my prediction is some time in the next 12 months, especially before the next presidential election, you'll see the swinging door at msnbc again and there will probably be new faces and some of the newcomers of the last year or so will be gone. >> maybe they'll make you a big offer and we'll have to top it. >> yeah, bill, that's going to be a tough one. >> ms. laura ingraham, everybody. plenty more ahead this evening. kelly on two-court rulings, one on religion, the other on welfare drug use.

man was gunned down in new jersey by four african-americans and not a word out of al sharpton about this. first of all, what happened there? >> yeah, they caught the four guys responsible. he was shot in the head on december the 14th, 15th, rather, late last year, and the four guys are in jail, in essex county, new jersey now, and charged with a whole slew of crimes, murder, felony murder, conspiracy, what have you. >> what happened was this lawyer and his wife were christmas shopping at a mall and these four, two of them just out of prison, were cruising to try to carjack and shot the guy in the head. so this is a crime, it's a crime, and it could be committed by any race, and it is, there are carjackers by hispanics, whites, everybody else. should somebody like sharpton, who's always mouthing off about how blacks are treated poorly in the criminal justice system, be saying something about this. >> the prosecutor says this doesn't appear racially motivated, it's about a car,

under obamacare. here to explain, ms. megan kelly. so, sotomayor is a liberal woman. >> yes. >> she did what? >> barack obama appointee to the u.s. supreme court, but she oversees the 10th circuit, colorado and other states, so this appeal was necessarily going to her, and she said that that piece of obamacare may not be enforced against these religious groups that are within this plan. it was a group of nuns objecting, because -- until the obama administration has a chance to file a defense on friday. >> okay. >> suggesting they might have a likelihood of success, the nuns may. >> little sisters of the poor in denver. these aren't militant women. they are women who believe -- >> they are nuns! >> believe me, i have nuns, kelly, don't tell me about them. these are nice. they say, look, you know, leave us alone, we're providing a service here. don't force us to do things. >> obamacare said you have to provide contraception coverage if you want to get your tubes tied, you have to pay for that,

all this stuff. the nuns and priests and religious groups not directly with the church want an exemption. the obama administration said you can have one, but in order to get this exemption, you have to certify sort of permission, if you will, for your employees to get this coverage from the insurance company, and the nuns say, look, that may provide us political cover on paper, but we have a moral -- >> we don't want to be involved at all. >> we don't want to sign a permission slip either. >> as you know, kelly, because you've watched this program and study it very, very closely. >> religiously, speaking of religion. >> which is why you got the 9:00 slot. for years i've been saying that the entitlement society has got to regulate people addicted to substance. you cannot keep pouring in money and resources to drug addicts and alcoholics, because they spend the money on the drugs and the booze. go to any neighborhood that has a lot of crime, and on welfare payment check day, the dope

n the u.s., lined up. everybody knows this. so florida tried to stop it, or at least regulate it, by drug testing people who want welfare payments, and now a pin head judge has said, you can't. it's an invasion of privacy, correct? >> you were doing well up until the pin head part. she got it dead right. the judge issued the right ruling. florida overstepped its bounds. their heart may have been in the right place, but they are not allowed to just randomly -- not randomly, mandatorily drug test everyone applying for welfare, and i said this on your show, i predicted this would happen, i predicted it on my afternoon show, that this would be struck down, and it has been. the reason is -- >> how do you get around this? >> listen, there's a fourth amendment in this country, you cannot engage in unreasonable searches or seizures. >> it's not unreasonable when you're applying for money from the state. >> yes, it is, your assumption

those people are druggies or alcoholics. there needs to be reasonable suspicion before you can engage in a search. doesn't say if you want public assistance. >> i understand your point of view, i disagree with it. >> 108 out of over 4,000 people drug tested in the state of florida were found to be using narcotics. >> you know why, the others don't show up for the test. >> it costs more to go through this program than it did without it. >> is there any way around this to hold people accountable? >> yes, yes, which is to require reasonable suspicion. if you've had a conviction for a drug arrest, then, then we require you to undergo drug testing. >> what about an arrest? >> that's dicier, but maybe, maybe. there are nine states that have done this, welfare or unemployment benefits on drug testing. the law tends to be going the way this does, you can't do it to all applicants. >> i understand it, but in a public policy arena, it's
